(c) Tiebreaker: If there is any inconsistency, the entity named on your order confirmation/invoice prevails.
References to “Bharat Job Mart Pvt. Ltd.” or “Bharat Job Mart” prevail wherever a specific obligation, right, or role (e.g., Principal, Commissionaire, Controller, Processor) is described.
Scope and Subject Matter of these General Terms and Conditions
All following provisions refer to the Bharat Job Mart platform, including software (“Bharat Job Mart Software”) and associated services (“Bharat Job Mart Platform”) offered by Bharat Job Mart Pvt. Ltd., Ghaziabad, U.P. (“Bharat Job Mart”) on bharatjobmart.com to jobseekers (“Candidates”), hereinafter referred to as “Users.”
These General Terms and Conditions (“GTC”) exclusively apply to all Users of the Bharat Job Mart platform. Any User licensing conditions or terms not explicitly accepted by Bharat Job Mart are not a part of the contract, even if Bharat Job Mart provides services without knowledge of contradictory terms.
Persons under 18 years of age are prohibited from registering or using the platform. Bharat Job Mart may verify User identities by requesting suitable evidence.
Platform/Availability
Bharat Job Mart offers an internet-based career service for searching and communication. Users can search third-party job ads and use tools to publish content (e.g. resumés). Bharat Job Mart does not provide job placement or personnel placement services. Its role is limited to providing access and facilitating communication, not guaranteeing successful job placement.
Users may register for free membership or a paid Premium Membership. Upon successful registration, the User obtains a personal, non-transferable, non-exclusive right to use the platform for private purposes as per these terms. Any other use requires prior written consent from Bharat Job Mart.
Bharat Job Mart aims for high availability but does not guarantee uninterrupted service due to factors such as maintenance, force majeure, or other issues beyond company control. Program errors cannot be ruled out.
Bharat Job Mart does not guarantee accuracy of communications between Users; recipients must verify data accuracy and completeness.
No User is guaranteed successful job placement.
User Obligations
- Users are solely responsible for the content of their profiles, job ads, or communications, and all information must be truthful.
- Bharat Job Mart is not responsible for User statements or actions unless it explicitly associates itself with them.
- Users cannot upload sexual, pornographic, immoral, politically radical, or otherwise illegal content. All data must be legal and free from third-party rights.
- Creating or managing profiles for third parties is prohibited.
- Emails/messages received through the platform must be kept confidential without author consent.
- Users must retain a backup of all offers and information placed on the Bharat Job Mart platform in case of system outage.
- Any use outside intended platform purposes is prohibited, especially collecting, using, or online exploitation of data for commercial purposes.
- Use of unauthorized mechanisms, software, or scripts, including robots/crawlers, is prohibited. Users may only use provided interfaces or software.
- Users must avoid actions that overload or negatively impact platform infrastructure.
Salary Benchmark and Third-Party Information
Salary benchmarks or information are estimates for the relevant segment. Actual salaries depend on multiple factors (negotiation skills, company size, location, experience, etc.). Stated salaries are guidelines only, not actual salaries offered by specific companies.
Other Provisions
Upon evidence of User violation (laws, third-party rights, terms, justified interests), Bharat Job Mart may issue warnings, delete content, restrict or block the User, or terminate accounts as appropriate. Actions consider platform needs, liability risks, and Users’ interests. Users may be given time for a statement and notified of actions. Statutory rights remain unaffected.
Governing Law and Venue
These Terms are governed by the laws of India. Exclusive jurisdiction rests with courts of Ghaziabad, U.P. Mandatory consumer protections under Indian law remain unaffected.
Additional Provisions for Candidates
General Provisions for Candidates
Candidates may use the platform to search for jobs, apply, establish contacts, and recommend positions. Free basic membership offers limited access; full use requires paid Premium Membership.
Bharat Job Mart is intended for qualified specialists/managers, who must demonstrate qualifications and provide accurate information.
Conclusion of Contract and Costs
Free membership is concluded upon registration. Opening and amending a profile is free. Applying and receiving contact requests from others responding to the profile is also free.
Premium Membership provides full platform access and is concluded upon selection of membership duration and acceptance of Bharat Job Mart’s offer by clicking “Buy membership.” Corrections can be made prior to registration, and afterward under “My Account.”
Bharat Job Mart confirms contracts via automated email, detailing membership, payment methods, total amount, these GTC, and right of withdrawal. Contract details are available under “My Account.”
Term and Termination of Free Membership
Either party may terminate free membership at any time. Termination by Bharat Job Mart takes effect three days after notice; Candidate terminations take effect immediately. Written notice or email to contact@bharatjobmart.com or profile deletion is sufficient.
Right to extraordinary termination exists for intentional false information or repeated GTC violations after warning.
Term and Termination of Premium Membership
Premium Membership is for a fixed term, extendable up to one year as agreed, unless timely terminated per contract.
Termination can be requested via “Terminate membership” in portal or via email to contact@bharatjobmart.com with identifiable Candidate information.
Extraordinary termination rights remain for intentional false information or repeated GTC violations after warning.
Payment Conditions for Candidates
Fees for Premium Membership must be paid in advance without deductions. Payment is automatically processed per contract. By registering and supplying payment information, Candidate authorizes direct debit/card charging per contractual intervals.
If payment fails, Bharat Job Mart may retry and reduce intervals appropriately.
Candidate Obligations
- Profiles must not include commercial advertising for personal or third-party benefit.
- Photos in profiles must be current and allow user identification.
- Applications are freely made, not influenced by Bharat Job Mart.
Cancellation Policy for Consumers
Right of Withdrawal
This applies only to consumers in India where mandatory law grants such rights. Otherwise, no statutory withdrawal right applies.
Users may withdraw from the contract within fourteen (14) days without justification, starting from contract conclusion.
To exercise the right, notify Bharat Job Mart via email to contact@bharatjobmart.com with a clear statement. The Standard Withdrawal Form may be used if desired. Timely notice before period expiration suffices.
Consequences of Withdrawal
On withdrawal, Bharat Job Mart will refund all payments, including shipping (except for extra chosen delivery methods), via the original payment method within fourteen days of withdrawal notice. No fees will be charged for refunds.
If services have started during the withdrawal period, payment for services actually provided up to date of withdrawal is required.
